Medical records follow-up letter templates for law firms

Three follow-up letters for an overdue medical records request, a follow-up log to copy and when to hand it to the attorney. For PI firm staff.

A follow-up letter for an overdue medical records request should name the patient, the date of birth and the date your original request went out. It should say exactly which records and dates are still outstanding, enclose a copy of the original request and signed authorization. Then ask the provider for a written status by a specific date. Keep it short and factual. Each follow-up gets a line in your log, so anyone on the team can see what was sent and what the provider said.

Below are three letters (first, second and final), a phone note, a follow-up log to copy and a short guide to when the file goes to the attorney.

These templates are for administrative use. If your attorney wants a letter to cite a law or a response time, they should add that wording themselves.

Before you send any follow-up

Check three things first. It saves sending a letter the provider will just bounce back.

  • The provider received the original request. Look for a fax confirmation, portal receipt or tracking record. If you can't find proof, resend the original instead of following up.
  • Nothing came in already. Search the case folder and the shared inbox for records from this provider.
  • The address is right. Records often go to a records department or an outside retrieval company, not the clinic's front desk. A quick call to confirm the address is worth making before you send anything.

Template 1: first follow-up

Use this when the follow-up date in your tracker arrives with nothing back.

Re: Follow-up on records request
Patient: [Full name]
Date of birth: [DOB]
Dates of service: [From] to [To]
Original request sent: [Date] by [fax / mail / portal]
Our reference: [Case number]

Dear Records Team,

We sent a request for the records listed below on [date]. We haven't received them yet and are following up.

Records requested:
- [Medical records / itemized bills / imaging reports] for [dates]

A copy of our original request and the patient's signed authorization are enclosed.

Please send the records to [fax / email / upload link / address] or let us know their status by [date]. If you need anything else from us, such as your own authorization form or a fee payment, please tell us and we'll send it straight away.

Thank you,

[Name]
[Title], [Firm]
[Phone] | [Email]

Template 2: second follow-up

Send this if the first follow-up got no answer. Make it more specific: if you called, name the person you spoke to. Ask for a direct contact too.

Re: Second follow-up on records request
Patient: [Full name] | DOB: [DOB]
Original request: [Date] | First follow-up: [Date]
Our reference: [Case number]

Dear [Name, if you have one / Records Team],

This is our second follow-up on the request we sent on [date]. We still haven't received the records below. We haven't had a status update either.

Still outstanding:
- [Record type] for [dates]

[If you called:] I spoke with [name] on [date], who said [what they said].

Please send the records or a written note of their status by [date]. If there's a problem with the request, please name it so we can fix it. Could you also give me a direct contact for this request?

Copies of the original request, the first follow-up and the signed authorization are enclosed.

Thank you,
[Name], [Firm], [Phone]

Template 3: final follow-up

Use this one only after the attorney or case manager has seen the file. See the escalation section below. It goes to the records supervisor or practice manager by name if you can find one.

Re: Final follow-up on records request
Patient: [Full name] | DOB: [DOB]
Requests sent: [Date], [Date], [Date]
Our reference: [Case number]

Dear [Records supervisor / Practice manager],

We've asked for the records below three times since [date of first request] and haven't received them or a status update. Our log of each request is enclosed.

Still outstanding:
- [Record type] for [dates]

Please send the records or a written status by [date]. If you can't release them, please tell us why in writing so we can tell our client.

[Optional line added by the attorney.]

Thank you,
[Name], [Firm], [Phone]

Partial records: a short version

If some records arrived but not all, don't restart from Template 1. Thank them for what came in and list only the gap.

Re: Records received: items still missing
Patient: [Full name] | DOB: [DOB] | Our reference: [Case number]

Thank you for the records received on [date]. These items from our request of [date] are still missing:
- [For example: visit notes after 2 May]
- [For example: itemized bill]

Please send them to [fax / email] by [date]. If they don't exist, please tell us.

Phone note

Calls get answers letters don't, but only if you write them down. Use the same fields every time:

Date / time:
Called: [number] | Spoke to: [name, role]
What they said:
What they need from us:
Promised by (date):
Next step and date:

The follow-up log

Keep one log line for every contact, in the same place as the request tracker. If your firm uses a medical records request tracker, add this as a notes tab or a linked table.

Date

Provider

Method

Contact

Stage

What they said

Next step

By

Fax / call / portal / mail

1st / 2nd / final / partial

Two rules keep the log useful. Every line ends with a next date. Every line is written the same day as the contact.

When to escalate to the attorney

Staff can send the first and second follow-ups on their own if your firm allows it. Hand the file to the attorney or case manager before the final follow-up. Hand it over straight away in any of these cases:

Situation

Why it goes up

The provider says it can't or won't release the records

That decision and what to tell the client sits with the attorney

The provider wants a fee you weren't expecting or one above the amount your firm lets staff approve

Someone with authority has to approve or dispute it

The provider says the authorization isn't valid or wants a different form

The attorney decides how to respond and what the client needs to sign

The provider says there are no records for those dates

It may affect the case, so the legal team needs to know

A firm deadline is coming and the records are still missing

The attorney decides what to do next

The request has gone past your firm's own limit for how long a request can stay open

That's what the limit is for

We don't list legal response times here. They vary and they're a legal question. If your attorney wants them tracked, add a column with the date they give you.

Taking the busywork out

Most of this is copying details from one place to another: case, provider, dates, the date of the last letter. That's the part worth automating. A follow-up date can trigger a draft letter filled in from the tracker. A person reads it, approves it and sends it. The log line is added at the same time. Runnrr assesses the connections and approval steps for workflows like this around the case management software and inbox a firm already uses. Frequently asked questions

What should a medical records follow-up letter include?

The patient's name and date of birth, your case reference, the date of the original request, the exact records and dates still outstanding, a copy of the original request and signed authorization. Add a date by which you'd like the records or a status.

How many times should a law firm follow up on a medical records request?

Many firms use three written follow-ups (first, second and final), with phone calls in between. Each firm sets its own spacing. The attorney should see the file before the final letter goes out.

What's the difference between a follow-up letter and a new records request?

A follow-up refers to a request the provider already has and asks for its status. A new request starts again from scratch. Only send a new one if the provider never received the first or if you need different dates or record types.

What should a records request follow-up log track?

The date, case, provider, method, who you spoke to, the follow-up stage, what they said, the next step, the next date and who did it.

When should a paralegal escalate an overdue records request?

Before the final follow-up. Escalate at once if the provider refuses, wants an unexpected fee, rejects the authorization, says there are no records or a firm deadline is close.
